In addition, we have extensive experience in innovative instruments, such as Labor Audits, a tool that has allowed a wide range of companies to have a more complete knowledge of the reality of their Human Resources Department, its strengths and weaknesses.
Labor practice has always been one of our strenghts. We have a long history of advising multinational companies with more than 5,000 employees in the Dominican Republic on all labor matters. We advise clients from the hotel, free zone, manufacturing, pharmaceutical and advertising industries on complex labor matters, including several labor related litigation cases.
We provided advice in the face of the Covid-19 pandemic, such as reduced workload arrangements, remote work, suspension of employees, employment contract termination, health and safety measures in the workplace, registering for the Employee Solidarity Assistance Fund (FASE), among others. We have assisted companies with suspending employment contracts, thus avoiding labor contingencies and mass layoffs according to the criteria of job preservation indicated by the Ministry of Labor, as well as helping register suspended and active employees in FASE. Likewise, we guided companies on the steps to follow in case they had to reduce their payroll of permanent workers, as well as advising on the flexibility of the working day and adjusting salaries according to the working day to avoid layoffs.
One of the great virtues of our Labor Department is that we have maintained a 95% success rate in labor litigation cases, where each case is unique, according to its characteristics and the particularities of the industry. We help achieve good efficiency by reducing our clients’ job liabilities and mitigating potential occupational and reputational risks during the pandemic.
